Legal Strategy Mirrors Trump’s Recent Court Victory
Hunter Biden, the son of U.S. President Joe Biden, has asked federal judges to dismiss both gun and tax charges filed against him, using an argument recently employed by Donald Trump in a separate legal matter. On July 18, Hunter Biden’s lawyers filed motions in Delaware and California, requesting the dismissal of the gun conviction and tax charges based on the same grounds that led to the dismissal of charges in Trump’s case.
The case involving Hunter Biden stems from his 2018 purchase of a handgun while allegedly addicted to crack cocaine. He was convicted on three felony counts in June. Biden’s legal team referenced a ruling from District Judge Aileen Cannon, who dismissed criminal charges against Trump on July 15, asserting that the special counsel appointed to investigate Trump’s mishandling of classified documents was unlawfully appointed. Hunter Biden’s attorneys argue that the special counsels in his case were similarly unlawfully appointed, urging for the same outcome.
Despite the different defendants, Biden’s lawyers claim that the constitutional flaws in the Trump and Biden cases are identical. The special counsel overseeing both investigations, Jack Smith, is currently appealing Cannon’s ruling in Trump’s case.
Hunter Biden has faced a barrage of investigations by Republican lawmakers, primarily regarding his business dealings in China and Ukraine, but no criminal charges have been filed related to those matters. He is set to stand trial for tax evasion in September.
